This website is operated by GreatVacs, LLC (“GreatVacs”, “we”, “us”, “our”), a Utah limited liability company. We offer this website, including all information, tools and services available from it (the “Website”), conditioned on your acceptance of these Terms of Service (this “Agreement”).
By visiting the Website or purchasing from us, you agree to be bound by this Agreement, including the policies referenced in it. Please read it before using any part of the Website. We may update, change or replace any part of this Agreement by posting a revised version on this page.
1. User eligibility
The Website is available to individuals 18 years of age or older. By using the Website you represent that you are at least 18, that you have the legal capacity to enter into this Agreement, and that you are not prohibited from doing so by another agreement. If you use the Website on behalf of a business or other third party, you represent that you have authority to bind that party to this Agreement.
2. Intellectual property and non-affiliation
The Website, its trademarks and its content are owned and used by GreatVacs. The selection, arrangement and layout of the Website are our sole and exclusive property. Use of the Website, its trademarks or its content without our prior written approval is prohibited, including copying, public display, public performance, distribution and the creation of derivative works, in whole or in part.
GreatVacs is an independent retailer. We are not affiliated with, authorized by, endorsed by or sponsored by The Kirby Company or Rexair LLC (maker of Rainbow). Kirby® and Rainbow® are registered trademarks of their respective owners and are used on this Website only to identify the machines we rebuild and the parts that fit them.
3. User-generated content
We may allow you to submit content through the Website, including product reviews, questions, photographs, suggestions and other materials (“User-Generated Content”). You represent that your User-Generated Content will not violate any applicable law, this Agreement, or the rights of any third party, including intellectual property and privacy rights, and that any information you provide is accurate, truthful and not deceptive.
By submitting User-Generated Content you grant GreatVacs a non-exclusive, irrevocable, royalty-free, worldwide, perpetual license to use it for the customary and intended purposes of the Website. We may edit, copy, publish, distribute and translate it in any medium. We are not obligated to keep it confidential, to pay compensation for it, or to respond to it, and we assume no responsibility for User-Generated Content submitted by users.
4. Acceptable use
You agree to use the Website only for its intended purposes and in accordance with this Agreement and applicable law. You are responsible for any breach of this Agreement and for losses we suffer as a result, including monetary damages, costs and reasonable attorneys’ fees.
You may not use the Website to violate the law or the rights of others. Prohibited activities include accessing the Website by non-standard or automated means (other than compliant search engines), circumventing technological protection measures, collecting personal information about other users, disrupting the operation of the Website, scraping or reproducing content, diverting customers, sending unsolicited communications, transmitting objectionable or destructive content including viruses and worms, reverse engineering, and encouraging others to do any of these things.
We reserve the right to modify, amend or terminate the Website or any of its content at any time without prior notice, and to refuse service or access to any person or entity at any time and without notice.
5. Pricing and product availability
Certain products are available exclusively online and may be available in limited quantities. We make reasonable efforts to display product colors and images accurately, but we cannot guarantee that your display will render colors accurately.
Product descriptions and pricing may change at any time without notice. We reserve the right to discontinue products, change product information or pricing, and change or withdraw offers where prohibited by law.
6. Ordering and payment
Payment for orders placed through the Website is due at the time of ordering. Prices displayed on the Website are an invitation to deal; a contract is formed only when we accept your order by shipping it. A pricing error does not create a contract.
All costs and fees are quoted and payable in United States Dollars. We are not responsible for foreign transaction fees, fees charged by your financial institution, or fees charged by our payment processor.
You agree not to initiate a chargeback against GreatVacs unless authorized by us in writing, and you are responsible for costs associated with an unauthorized chargeback.
7. Taxes
You agree to pay all taxes assessed by applicable governmental authorities in connection with your use of the Website and your purchase of products through it. We will report payments received from you to the appropriate taxing authorities.
8. Shipping
We provide free shipping on every order to the contiguous 48 states and the District of Columbia. We also ship to Alaska and Hawaii, with shipping calculated at checkout. We do not ship outside the United States. Orders ship from our own shop in Montpelier, Idaho. Delivery estimates are estimates only and are not guaranteed.
9. Refunds and exchanges
We accept returns and offer refunds and exchanges on most qualifying products within 61 days of purchase when purchased directly from GreatVacs.com. Products purchased through other sales channels are subject to that channel’s return window, which is typically 30 days.
If a product is defective, we will reimburse return shipping costs. If the return is elective and the product is not defective, you are responsible for return shipping. We do not charge handling, re-cleaning, re-boxing or credit card processing fees on returns.
We strive to honor return and exchange requests within 61 days of purchase but reserve the right to review claims on a case-by-case basis and at our discretion. Full details are in our Returns & Refunds policy.
10. Accuracy of billing and account information
We reserve the right to refuse any order. We may limit or cancel quantities purchased per person, household, order, customer account, credit card, billing address or shipping address, and may limit or prohibit orders from dealers, resellers or distributors. Where an order is changed or canceled we may notify you using the contact information you provided.
You agree to provide current, complete and accurate account and purchase information, and to update it promptly — including your email address, credit card number and expiration date.
11. Rebuilt and pre-owned products
Except where a listing expressly states otherwise, the vacuums sold through the Website are pre-owned machines that have been professionally rebuilt by GreatVacs. Rebuilt machines are disassembled, cleaned, tested and fitted with new wear components before sale.
Cosmetic condition varies between individual machines. Minor surface marks consistent with prior use are normal and are not considered a defect. Product photographs are of the actual machines we rebuild, and what is pictured is what ships: the pictures are the packing list.
Parts and accessories described as aftermarket are made to fit the machines identified in the listing and are not manufactured by Kirby or Rexair. It is your responsibility to confirm that a part fits your machine before ordering.
12. Limited warranty
Rebuilt Kirby and Rainbow vacuums sold through the Website carry a five-year limited warranty on moving parts, beginning on the date of purchase. Rebuilt Filter Queen vacuums carry a five-year limited warranty on the motor.
The limited warranty does not cover normal wear items — including belts, filters, bags and brushrolls — cosmetic wear, or damage resulting from misuse, neglect, accident, unauthorized modification, or use in a commercial setting. The warranty is offered by GreatVacs, is not a manufacturer warranty, and is non-transferable.
The five-year warranty applies to rebuilt vacuum cleaners only. Parts and accessories purchased separately are not covered by it, and are instead subject to the 61-day window described in section 9. After that window, parts and accessories are sold as-is.

13. Third-party websites
The Website may contain links to websites operated by third parties. Those websites are not controlled by us, and we are not responsible for their content, products, services or privacy practices. Links are provided for convenience and do not imply endorsement.
14. Errors and omissions
We are not responsible if information on the Website is not accurate, complete or current. The material on the Website is provided for general information only. The Website may contain historical information, which is provided for reference and may not reflect current circumstances. We reserve the right to correct errors, inaccuracies and omissions, and to change or update information at any time without prior notice.
15. Term and termination
This Agreement is effective while you use the Website. We reserve the right to terminate the Website, or your access to it, at our discretion and without prior notice. Obligations and liabilities incurred before termination survive it.
16. Disclaimer of warranties and limitation of liability
16.1 The Website is provided on an “AS-IS” basis and without warranties of any kind, whether express or implied, including warranties relating to title, merchantability, accuracy, fitness for a particular purpose, security and non-infringement.
16.2 Except for the limited warranty described in section 12 and any applicable manufacturer warranty, products sold through the Website are provided AS-IS. We disclaim liability for personal injury, property damage or business losses arising from the use or misuse of any product.
16.3 We disclaim responsibility for damages arising from your use of the Website, including compensatory, consequential, special, incidental and punitive damages.
16.4 Our total liability to you is limited to the amount you paid for the product giving rise to the claim, or $500, whichever is less.
16.5 Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limitations above apply to the fullest extent permitted by law.
17. Indemnification
You agree to indemnify, defend and hold harmless GreatVacs, LLC and its officers, members, managers, employees, subsidiaries, affiliates and representatives from and against any loss, liability, claim or demand, including reasonable attorneys’ fees, arising out of your use of the Website, your purchase of products through it, or your breach of this Agreement or of applicable law.
18. Choice of law and dispute resolution
18.1 This Agreement, and any dispute arising out of or relating to it, is governed by the laws of the State of Utah, without regard to its conflict-of-law rules.
18.2 Disputes will be resolved by final and binding arbitration administered by the American Arbitration Association under its applicable consumer rules. Arbitration may take place in Salt Lake County, Utah; by telephone; online; or through written submissions.
18.3 Dispute resolution proceedings will be conducted on an individual basis only. Class, consolidated and representative actions are not permitted.
18.4 Any claim must be brought within one year of the applicable purchase, or it is barred.
19. Force majeure
We are not liable for any delay or failure to perform caused by circumstances beyond our reasonable control, including acts of God, natural disaster, fire, flood, epidemic, labor dispute, carrier delay, supplier failure, utility or network outage, war, terrorism, or governmental action.
20. Severability, assignment and waiver
If any provision of this Agreement is found unlawful or unenforceable, that provision is severable and does not affect the validity of the remaining provisions. Our failure to exercise or enforce any right is not a waiver of it. You may not assign this Agreement without our written consent; we may assign it in connection with a merger, acquisition or sale of assets.
21. Entire agreement
This Agreement, together with the policies posted on the Website, constitutes the entire agreement between you and GreatVacs and supersedes any prior agreements or representations. Ambiguities are not to be construed against the drafting party.
